Notice of Collection of Personal Information
ADR Chambers ("ADRC") collects, uses, and discloses your personal information in accordance with the Freedom of Information and Protection of Privacy Act (FIPPA), R.S.O. 1990, c. F.31, and the federal Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5, as applicable.
Who is collecting your information
ADR Chambers is the collector of the personal information provided through this portal. ADRC operates the complaint intake and case management service under contract to the named provincial agency identified in your complaint.
What is collected
Through the complaint intake form we collect:
- your full name;
- your email address;
- a short reference code identifying the agency complained against; and
- your written description of the events giving rise to your complaint, including any names or details you choose to include.
When you correspond with us through the portal after a case is opened, ADRC may also receive and store documents, messages, and other information you choose to provide.
Purpose of the collection
Your personal information is collected for the purpose of administering the independent complaint resolution service provided by ADRC under its contract with the relevant agency. Specifically, this includes:
- creating and managing a case file;
- communicating with you about the status of your complaint;
- requesting and reviewing the agency's case file;
- producing decisions, reports, and statistical summaries; and
- meeting ADRC's records-retention and audit obligations.
Legal authority
Collection is authorized under section 38(2) of FIPPA where the agency is an institution under that Act, and under PIPEDA where the agency operates in the federal commercial sphere. In both cases collection is for the lawful purpose of administering the contracted complaint resolution program.
Retention
Case records, including the personal information you provide, are retained for seven (7) years following the closure of the case, in accordance with ADRC's Records Retention Policy. After the retention period the records are securely destroyed.
Access and correction
You have the right to request access to, or correction of, your personal information held by ADRC, subject to the exemptions set out in FIPPA and PIPEDA.
